RULE TITLE: School Board Meetings
RULE NUMBER: Policy 1.03
SUMMARY: This policy governs the process and procedures for school board meetings, including the standing rules and by-laws on the rules of order, regular board meetings, Florida Sunshine law, special meetings, workshops, board discussion items, public comment, civility and decorum, voting methods, agendas, expulsion meetings, and special rules of order. Proposed revisions will incorporate required compliance with the case of Moms for Liberty – Brevard County, FL v. Brevard Public Schools, 118 F.4d 1324 (11th Cir. 2024).
PURPOSE AND EFFECT: The revisions will clean up the outline format, word choice, and tense. The purpose of this Policy is to provide for the efficient and orderly functioning of the business of the School Board and to protect the rights of participants. The effect will incorporate required compliance with the case of the above-referenced Moms for Liberty – Brevard County, FL 2024 decision. Additional amendments relate to the requirements and process for Board discussion items and amend the special rule of order, and deleted the time limit for a Board member to discuss a debatable motion.

RULE TITLE: Employment of Substitute Teachers, Teachers of Adult Education, and Non-Degreed Teachers of Career Programs
RULE NUMBER: Policy 3.85
SUMMARY: Policy 3.85 authorizes the Superintendent to employ the above-referenced categories of teachers and outlines the required qualifications, including educational credentials, licensure, and/or work experience. The policy incorporates updated citations to Florida Statutes and State Board of Education Rules and clarifies fingerprinting requirements and compensation access via the District’s public employment resources.
PURPOSE AND EFFECT: This policy outlines the employment standards for substitute teachers, adult education teachers, and non-degreed career program teachers. The policy has been revised to reflect current statutory references, clarify fingerprinting and qualification requirements, and reference available resources on the District website.

RULE TITLE: Exceptional Student Education Policies and Procedures
RULE NUMBER: Policy 5.725
SUMMARY: The proposed policy updates proposed procedures for the provision of special instruction and related services for exceptional students. Key accomplishments include changes in wording pre-populated by DOE to reflect recent legislative updates; current data for District Best Practices for Inclusive Education (BPIE); current restraint data and the District Plan to Reduce Restraint; the current data and District plan to Increase Participation of Underrepresented Students in Gifted Programs; and revisions to participation in alternate assessment based on DOE statute.
PURPOSE AND EFFECT: The School Board of Palm Beach County (Board) desires to ensure the School District's compliance with Fla. Stat. § 1003.57(1)(a)4 and State Board of Education Rule 6A-6.03411(2), requiring once every three years, for the School District to submit to the Department of Education its proposed procedures for the provision of special instruction and related services for exceptional students.

RULE TITLE: Promotion, Placement, Graduation – Student Progression Plans
RULE NUMBER: Policy 8.01
SUBJECT AREA TO BE ADDRESSED: The Student Progression Plan outlines the procedures for student promotion, retention, and graduation requirements. It also includes guidelines for informing parents about their child's academic progress and the criteria for accessing appropriate programs. This includes interventions, remediation programs, and access to academically challenging coursework that meets the students' needs.
PURPOSE AND EFFECT: To establish procedures for student promotion, retention, and graduation requirements in alignment with state law, State Board of Education Rules, and current practice.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST: The Agency has determined that a SERC is not required and has not prepared a SERC. The Agency has determined that based on information, including that contained in the proposed rule and the Board report, the rule is not expected to require legislative ratification. Any person who wishes to provide the District with information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing to the Board Clerk within 21 days of the publication of this Notice.

PUBLIC HEARING: IF REQUESTED, A PUBLIC HEARING WILL BE HELD DURING THE SPECIAL MEETING OF NOVEMBER 5, 2025. This Special Meeting will follow other Board meetings, including a workshop, and they are estimated to begin at 2 p.m. in the Boardroom at 3300 Forest Hill Boulevard, West Palm Beach, Florida. Persons requesting such a hearing must do so in writing by October 29, 2025, to the Board Clerk, at the same address. The proposal for adoption of the Policies is anticipated to be considered at the Special Meeting on November 5, 2025, in the Board Room. AGENDA: An agenda will be available by October 30, 2025 on the District’s website at http://www.boarddocs.com/fl/palmbeach/Board.nsf/Public.
