RULE NUMBER: Policy 4.101
SUMMARY: The proposed revised policy will streamline and clarify the administrative legal procedures for the School District. While the current policy adopts the Uniform Rules of Procedure in the Florida Administrative Code, this revision introduces specific procedural frameworks to facilitate the handling of petitions and pre-hearing motions.
PURPOSE AND EFFECT: The primary focus of this update is to delegate preliminary legal sufficiency reviews to the General Counsel, ensuring that administrative proceedings are handled with greater efficiency and consistency.

SUMMARY OF STATEMENT OF ESTIMATED REGULATORY COST: The Agency has determined that a SERC is not required and has not prepared a SERC. The Agency has determined that, based on information, including that contained in the proposed rule and the Board report, the rule is not expected to require legislative ratification. Any person who wishes to provide the District with information regarding a statement of estimated regulatory costs, or to provide a proposal for a lower cost regulatory alternative, must do so in writing to the Board Clerk within 21 days of the publication of this Notice.

PUBLIC HEARING: IF REQUESTED, A PUBLIC HEARING WILL BE HELD DURING THE SPECIAL MEETING OF SEPTEMBER 9, 2026. This Special Meeting will follow other Board meetings, including a workshop, and is estimated to begin at 1:30 p.m. in the Boardroom at 3300 Forest Hill Boulevard, West Palm Beach, Florida. Persons requesting such a hearing must do so in writing by September 2, 2026, to the Board Clerk, at the same address. The proposal to adopt the Policies is anticipated to be considered at the Special Meeting on September 9, 2026, in the Board Room.
